  1. Object and scope of application

2.1.- This Legal Notice establishes the general conditions of use that regulate access, browsing and use of the websitewww.espacioexploraterra.org/.com (hereinafter, the WEBSITE), as well as the responsibilities arising from the use of its content. Additionally, the provision of certain services or activities within the framework of the WEBSITE may also be subject to other specific conditions that may be established and that, where applicable, replace, supplement, and/or modify the general terms of use of this Legal Notice.. 

2.2.- This WEBSITE is a service that THE NAO VICTORIA FOUNDATION makes available to Internet users for informational, communication and commercial purposes through its online stores, and may make at any time and without prior notice any modifications it deems appropriate to its design, configuration and content.

2.3. Access to and use of this WEBSITE confers the status of USER upon the visitor and implies their full and unreserved acceptance, from the moment of such access and/or use, of each and every one of the terms of use that the NAO VICTORIA FOUNDATION includes in this Legal Notice, in the version published at the time of access. 3.1.- Access to this WEBSITE is free and open, except for the cost of connection to the telecommunications network provided by the operator contracted by each USER.

3.2.- The USER assumes responsibility for the use of the WEBSITE. This responsibility extends to any registration that may be necessary to access certain services or content.

The USER agrees to make proper, diligent and lawful use of the content and services that the NAO VICTORIA FOUNDATION offers through the WEBSITE, which entails, by way of example but not limitation, not using them for:

4.1.- The NAO VICTORIA FOUNDATION undertakes to process personal data in a manner that respects the rights of its owners, and in accordance with the data protection regulations in force at any given time. 

4.2. Each data collection form on the WEBSITE provides the USER with permanent access to basic data protection information, including the identification of the data controller, the purposes of the processing, and the rights the data subject may exercise, as well as a link to additional and detailed data protection information included in the WEBSITE’s privacy policy. The USER’s express acceptance of the privacy policy by checking the corresponding box is required for the form to be considered complete and for the submission process to be finalized. The content of this privacy policy may be modified to adapt to legislative changes that may occur, as well as to criteria and positions issued by supervisory authorities..

5.1.- The NAO VICTORIA FOUNDATION, either directly or as assignee, owns all intellectual and industrial property rights to this WEBSITE, as well as the elements contained therein (including, but not limited to, images, sound, audio, video, software or texts; trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), which are owned by the NAO VICTORIA FOUNDATION or its licensors. All rights reserved.

5.2.- The reproduction, distribution, transformation and public communication, including making available, of all or part of the content of the WEBSITE for commercial purposes, in any medium and by any technical means, is expressly prohibited without the prior and express authorization of THE NAO VICTORIA FOUNDATION

5.3.- The USER agrees to respect the intellectual and industrial property rights held by the NAO VICTORIA FOUNDATION. The USER may view the elements of the WEBSITE and even print, copy, and store them on their computer’s hard drive or any other physical medium, provided that it is solely and exclusively for their personal and private use. The USER acknowledges and accepts that the use of the WEBSITE, as well as its services and content, is at their sole risk and responsibility.

6.3.- The USER will be solely responsible for the contributions and comments made on this WEBSITE, and other participation tools, the NAO VICTORIA FOUNDATION reserves the right to remove those that, in its opinion, it considers not appropriate for publication.

7.1.- In the event that the WEBSITE contains links or hyperlinks to other Internet sites, the NAO VICTORIA FOUNDATION will not exercise any control over such sites and their content. Under no circumstances will the NAO VICTORIA FOUNDATION assume any responsibility for the content of linked third-party websites, nor will it guarantee the technical availability, quality, reliability, accuracy, completeness, truthfulness, legality, or validity of any material or information contained in any of these hyperlinks or other Internet sites. In this regard, if USERS become aware of any illegal activities carried out through these linked third-party websites, they must immediately notify the NAO VICTORIA FOUNDATION so that the link to them can be disabled.

7.2.- Likewise, the inclusion of any type of link by the NAO VICTORIA FOUNDATION to other Internet sites will not imply that there is any type of relationship, association, collaboration or dependence between the NAO VICTORIA FOUNDATION and the owner of the external website.

  1. Right of exclusion

8.1.- The NAO VICTORIA FOUNDATION reserves the right to deny or withdraw access to the WEBSITE and/or the content and services offered therein, without prior notice, to those USERS who fail to comply with these general conditions of use or the specific conditions that may be established.

9.1.- In case of discrepancy between the provisions of these general conditions of use and the particular conditions of each specific service, the provisions of the latter shall prevail.

9.2.- If any provision or content of this Legal Notice is declared null or unenforceable, in whole or in part, by a final decision of a competent Court or Tribunal, such nullity or unenforceability will not affect the remaining provisions of the terms of use, which will remain valid for all purposes.

9.3.- The failure of the NAO VICTORIA FOUNDATION to exercise or enforce any right or provision contained in these terms of use shall not constitute a waiver of such right or provision, unless acknowledged and agreed to by the NAO VICTORIA FOUNDATION in writing.

9.4.- The NAO VICTORIA FOUNDATION may modify, in whole or in part and at any time, the conditions determined herein, and such modifications will be effective from the moment of their publication on the WEBSITE.

The relationship established between the NAO VICTORIA FOUNDATION and the USER shall be governed by current Spanish law. For the resolution of any dispute, and unless otherwise provided by law, both parties submit to the jurisdiction of the Courts of Seville, expressly waiving any other jurisdiction..
